Biscuit means twice cooked. Therefore a jaffa cake cannot be a biscuit, unless it's very very burned.

But if they really did make a giant Jaffa cake to prove their point, I think that's pretty clever - it saves a lot of words (therefore time, therefore taxpayer's money) and shows the truth instantly. XD
